By accessing or using Pilotage Log (the "Service"), provided by Namcook Maritime LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Pilotage Log is a personal recordkeeping application designed for licensed U.S. merchant mariners. The Service allows users to log pilotage trips, track personal records, and generate PDF summaries of their activity for personal reference purposes only.
Important Disclaimer: Pilotage Log is a personal recordkeeping tool for professional reference only. This application does not provide official USCG documentation, certification, or compliance verification. For verified sea service required by the United States Coast Guard, mariners must obtain official documentation from their employer. Users are solely responsible for maintaining their credential requirements and ensuring compliance with all applicable regulations.
To use the Service, you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

The Service is offered on a subscription basis with monthly and annual payment options. Pricing is displayed on our website. By subscribing, you authorize us to charge your payment method for the selected subscription period.
Free Trial: New users receive a 14-day free trial. You may cancel at any time during the trial period without being charged. If you do not cancel before the trial ends, your payment method will be charged for the subscription you selected.
Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds are provided for partial billing periods.
All subscription fees are non-refundable. Cancellations stop future charges only and do not entitle you to a refund for any fees already paid.
The Service, including all software, text, graphics, logos, and other content, is owned by Namcook Maritime LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal recordkeeping purposes only.
You retain ownership of any data you enter into the Service. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMCOOK MARITIME LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

You agree to indemnify, defend, and hold harmless Namcook Maritime LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and usage practices.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service will immediately cease. We may, but are not obligated to, provide you with access to export your data within a reasonable period following termination.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice in the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions.
Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Rhode Island. You agree to waive your right to a jury trial or to participate in a class action lawsuit.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Namcook Maritime LLC regarding the Service and supersede all prior agreements.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
